Terms of service

Who you're dealing with

Firstlight Web Co is a sole operator based in Sydney, Australia, trading as a web design and website maintenance service. In these terms, "I" and "me" mean Firstlight Web Co, and "you" means the client.

Quotes and pricing

All prices are quoted in Australian dollars and confirmed in writing before any paid work begins. A quoted price is fixed for the scope described in it. If you ask for something outside that scope, I will tell you the additional cost and get your agreement before doing the work. You will never receive an invoice containing a charge you have not already approved.

Quotes are valid for 30 days.

The free mockup

I offer a free homepage mockup with no obligation. You are under no requirement to proceed, and no payment is owed if you decline. I retain ownership of any mockup you do not purchase, and you may not use it or have it reproduced elsewhere.

Payment

Unless otherwise agreed: 50% of the quoted price is payable once you approve the mockup and the build begins, and the remaining 50% is payable on completion, before the site goes live. Payment is by bank transfer. Invoices are due within 7 days.

Care plans are billed monthly in advance and may be cancelled at any time with no exit fee or notice period. Cancellation takes effect at the end of the current paid month.

What you provide

You are responsible for supplying content such as text, images, logos and business details, and for confirming you have the right to use them. I am not liable for claims arising from material you supply.

Revisions and timelines

Each package includes two rounds of revisions. In practice I generally continue until you are satisfied, within reason. Stated timelines (such as "live in 5 days") refer to my working time and assume you respond to questions and approvals. Delays in receiving content or feedback extend the timeline accordingly.

Ownership

On final payment, you own the completed website, its content and its domain name. Domains are registered in your name where possible. You receive all relevant log-ins and files. If you later move the site elsewhere, I will assist with the handover.

I retain the right to display the completed work as an example of my services unless you ask me not to.

What I don't guarantee

I do not guarantee any particular search engine ranking, volume of traffic, number of enquiries, or business outcome. Search rankings are determined by third parties and depend on factors outside my control, including competition, reviews and domain history.

I take reasonable care to keep sites secure and backed up, but I cannot guarantee uninterrupted availability, and I am not liable for outages caused by third-party hosting, domain registrars, or events outside my control.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. Subject to that, my total liability for any claim relating to the services is limited to the amount you have paid me for the service in question.

Cancellation

If you cancel a build after work has begun, the deposit covers work completed to that point and is non-refundable. If I am unable to complete a project, I will refund any amount paid for work not delivered.

Privacy policy

What I collect

When you use the contact form or email me, I collect the details you choose to give: your name, business name, email address, phone number, trade, service area and anything you write in the message field. If you become a client, I also hold billing details and any content you supply for your website.

Why I collect it

Solely to respond to your enquiry, prepare a mockup or quote, deliver the service, and issue invoices. That's it.

What I don't do with it

I do not sell, rent or trade your information. I do not add you to a mailing list without you asking. I do not run automated marketing follow-up sequences. I do not share your details with third parties for marketing purposes.

Who else touches it

Limited third-party services are involved in running the business: the form provider that delivers enquiries to my inbox, my email provider, and the web hosting and domain providers used for client sites. Each only handles what it needs to.

Analytics and cookies

This site does not set marketing or tracking cookies. If Google Analytics is enabled on a client site, that is disclosed on the site in question and configured with IP anonymisation.

How long I keep it

Enquiries that don't become projects are deleted within 12 months. Client records are kept for 7 years to meet Australian tax and record-keeping requirements.

Your rights

You can ask me what information I hold about you, ask me to correct it, or ask me to delete it. Email jake@firstlightwebco.com and I'll action it, generally within a few days.

This policy is handled in line with the Australian Privacy Principles under the Privacy Act 1988 (Cth). If you're unhappy with how I've handled your information, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.

Changes

If this policy changes, the updated version appears here with a new date at the top.
